These Terms of Use ("Terms") constitute a legal agreement between you and Yoan Gabison ("we", "us", "the developer") regarding your use of the Blackjack Edge mobile application ("the app"). By downloading, installing, or using the app, you agree to these Terms.
We grant you a non-exclusive, non-transferable, revocable license to use the app on any Apple-branded device that you own or control, subject to the Apple Media Services Terms and Conditions and these Terms. The Licensed Application End User License Agreement (Apple LGA) applies in addition to these Terms.
Blackjack Edge is an educational training tool. It teaches blackjack strategy and card counting using simulated gameplay with virtual chips that have no real-money value. The app is not a gambling application and does not facilitate real-money wagers. We do not guarantee any specific outcome, financial return, or advantage at real-money blackjack.
The app offers an auto-renewable subscription, Blackjack Edge Pro:
Payment is charged to your Apple Account at confirmation of purchase. Subscriptions auto-renew unless auto-renew is turned off at least 24 hours before the end of the current period. You can manage subscriptions and turn off auto-renewal in your Apple Account Settings after purchase. Any unused portion of a free trial is forfeited upon purchase. You agree not to: (a) reverse engineer, decompile, or attempt to extract the source code of the app; (b) use the app for any unlawful purpose; (c) attempt to disrupt the app, its servers, or related services; (d) submit fabricated scores or otherwise manipulate the leaderboard. Violations may result in account termination without refund.
When you create a leaderboard display name or submit scores, you grant us a non-exclusive license to display that content within the app. Display names must not contain profanity, impersonate others, or violate third-party rights. We reserve the right to moderate, remove, or reset display names and scores at our discretion.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not warrant that the app is free of errors, uninterrupted, or secure against all possible threats.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF YOUR USE OF THE APP. Our total liability for any claim arising from these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
Our Privacy Policy describes how we collect, use, and protect your data. By using the app, you consent to the practices described there.
You may stop using the app at any time and delete your account from the Preferences screen. We may suspend or terminate your access to the app if you violate these Terms. Upon termination, your right to use the app ceases immediately.
We may update these Terms from time to time. Material changes will be announced in the app or by email where applicable. Continued use of the app after changes take effect constitutes acceptance of the new Terms.
These Terms are governed by the laws of France, without regard to its conflict-of-laws provisions. Any dispute arising from these Terms shall be resolved in the competent courts of France, subject to applicable consumer protection laws that may grant you additional rights.
